Preamble

Mozark holds the protection of your personal data as essential to prevent any breach of privacy and civil liberties of its customers

In this context, Mozark respects the privacy rights and concerns of its customers and intends to provide its services in accordance with the data protection regulations. This privacy policy is a part of Mozark’s proactive and responsible approach.

Mozark processes your personal data, as a data controller, through a mobile application published by Mozark (the “application”). This application includes the 5GMARK engine or any of its derivatives, which has been created to measure the quality, the performance and the reliability of the mobile network connection, using key indicators on cellular.

Those services gather the data originating from the mobile phones inside a database, generating data analysis and customization.
This policy covers information collected through the following applications:

In part, the purpose of this policy is to notify users of Mozark’s policies and practices with respect to their data. Please read this privacy policy carefully to understand how Mozark will protect your personal data that you provide through the application.

What is the purpose of this policy?

The purpose of this privacy policy is to inform the users about the gathering, the processing, and the use of personal data. Mozark as data controller and in the context of its activity, is required to process personal data about you. Mozark places great importance on the protection of your personal data. The processing of your personal data in the context of this Policy complies with the applicable provisions in force, notably the law “Informatique et Libertés” of 6 January 1978 and the General Data Protection Regulation (Regulation EU 2016/679 of 27 April 2016) or “RGPD”.

In accordance with its legal obligations, and in order to ensure the proper application of these rules, Mozark has appointed a Data Protection Officer (DPO).

When is the data collected?

Personal data is collected through:

  • your authentication if there is through the application;
  • the use of the application’s services;
  • the process of requests and claims;
  • performing connection tests and measuring the quality of the services.

What kind of information is gathered?

Several categories of personal data may be processed by Mozark on the mobile applications or website, this treatment may vary depending on the media.

Mozark may be required to process the following non-directly personal data:

  • [optional] Digital IDs (email address, password) only in the case of the creation of a user account
  • [mandatory] Technical data regarding devices (brand, model, product) and network (cellular radio and technology, Wi-Fi, signal strength) IP address stored truncated to respect anonymization
  • [mandatory] Geolocation data of tests (location of the measurement)
  • [mandatory] Audience and crash or app-issues logs

How do we use the data?

Users are informed of the purpose(s) of the processing of their Personal Data during the collection. The treatment is based on the consent of the User.

Personal Data is processed on the site or via the mobile application for the following purposes:

  • Digital IDs (email address, password) are used only for login purposes to the user account;
  • Session data is used to complete the tests;
  • The geolocation data of the test allow the restitution of the position of the measurement results on maps, which is one of the services offered by the connection tester;
  • The anonymized analyzes, resulting from the geolocation, test results and technical data processing, are intended for publication and communication by Mozark.

Who will receive the data?

They are also intended for the company Mozark which collects on our behalf the data, which has the technology that it puts at our disposal. The analyzes, derived from the aggregated processing of test geolocation data, are intended for publication and communication by Mozark.

Mozark may be required to communicate anonymized test data from the measurement tool to its partners (local authorities, regulatory bodies in the field of telecoms and the Internet, organizations in charge of telecom infrastructure investments).

Mozark collects the collected data for transmission to its own partners, such as operators, regulators, equipment manufacturers, local authorities, with a view to improving the services offered.

In addition, your Personal Data may be communicated to any authority legally entitled to know, especially in case of requisition from judicial, police or administrative authorities.

How long do we keep the data?

Mozark undertakes to keep the Personal Data for a limited and proportionate duration that does not exceed that necessary for the purposes for which they are processed. Personal Data are kept for the period necessary to fulfil the purposes mentioned below, in particular to meet the legal obligations:

The connection, navigation and traffic data are kept for a maximum of one year, in accordance with legal obligations.

  • The data relating to the users’ accounts are kept for a limited period covering at least the duration of your registration, to which is added the prescription period of the contractual action (5 years).
  • It is specified that all of these Personal Data may however be kept longer than the aforementioned periods, or after obtaining your agreement; either, after anonymization, in the form of archives for the purposes of historization and scientific statistics; either to meet the legal and regulatory obligations that may be imposed on Mozark or during the legal limitation or opposition period.

How can you exercise your rights?

You have a right of access, rectification, limitation, portability, opposition, deletion of your Personal Data. You also have the option to set your instructions after death on the fate of your data (called post-mortem guidelines), under legal conditions.

If you have opened a user account, you can request deletion. To exercise your rights, we may ask you to prove your identity.

How secure is your data?

We use reasonable precautions to protect your personal data from accidental loss and unauthorized access, collection, use, disclosure, duplication, modification, disposal, destruction. You should be aware, however, that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

Will this privacy policy ever change?

This privacy policy may be modified or adapted at any time to stay compliant with relevant laws. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible.

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device’s internal memory.

This Service does not use these “cookies” explicitly. However, the app may use third-party code and libraries that use “cookies” to collect information and improve their services. Children’s Privacy

These Services do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to do the necessary actions.
